General Terms and Conditions of Fabru GmbH, May 30, 2018
 
 
1. General points
 
These general terms and conditions (hereinafter referred to as GTC) apply to all orders that you place in the Fabru GmbH online shop. These terms and conditions also apply to orders by email or telephone.
 
 
2. Offer
 
2.1 The offer of Fabru GmbH is aimed at customers over 18 years of age who are capable of acting. The offers of Fabru GmbH are non-binding and are not to be understood as binding offers.
2.2 The customer receives an order confirmation which is not binding. An order only comes into being when the shipment has been confirmed or the goods ordered are ready to be picked up.
 
 
3. Ordering and delivery
 
3.1 Orders are accepted via the website www.fabru.eu as well as by e-mail or telephone. If it is determined after the order confirmation that an article is not available, the corresponding order will be canceled. The customer cannot assert any further claims.
3.2 The delivery period stated in the offer or in the confirmation of receipt of order is only a guide and is not binding.
3.3 Fabru GmbH is entitled to make partial deliveries. If part of the ordered goods cannot be delivered, there is no right to cancel the entire order. The customer cannot assert any further claims.
3.4 Delivery is carried out exclusively at the expense and risk of the customer. Basically, delivery is only made to the customer's curb / post office box.
3.5 When collecting the goods, the customer must collect the ordered goods from Fabru GmbH within 10 days. If the goods are not accepted within the collection period, Fabru GmbH has the right to cancel the contract and can claim compensation for expenses.
3.6 The customer undertakes to immediately check the delivered / picked up goods for correctness, completeness and intactness. Damage to the delivered / picked up goods must be reported to the transport company and Fabru GmbH as soon as possible, but no later than 5 calendar days after delivery. In the event of complaints, all parts of the original packaging must be kept. These may only be disposed of with the written consent of the transport company or Fabru GmbH.
 
4. Prices
 
4.1 Fabru GmbH has the right to change the price at any time. The price that is published at the time of the order applies. Price changes made after the order was placed will not be taken into account.
4.2. All prices of Fabru GmbH include value added tax (VAT) and advance recycling fee (VRG) in Swiss francs, euros or US dollars. Additional costs (e.g. shipping costs, packaging costs, surcharges for certain means of payment) are not included in the price and are shown separately and can be charged separately. We reserve the right to make technical changes, errors and misprints.
 
 
5. Payment and retention of title
 
5.1 Fabru GmbH has the right to add surcharges to individual means of payment. Fabru GmbH reserves the right to obtain credit checks on the customer and for this purpose can pass on customer data to third parties.
5.2 When paying on account, the billing and delivery addresses must be the same. The invoice is issued at the time of delivery. Invoices are to be paid within 10 calendar days.
If the customer is in default of payment in whole or in part, Fabru GmbH can also cancel and / or discontinue all further orders without a reminder until the entire claim has been paid. Fabru GmbH also has the right to assign outstanding debts to external debt collection companies.
5.3 In the case of prepayment, the customer transfers the invoice amount within 10 days of receipt of the order confirmation. If the advance payment is not received by Fabru GmbH within 10 days, it is entitled to withdraw from the contract without further notice.
5.4 The products delivered by Fabru GmbH or picked up by customers remain the property of Fabru GmbH until the entire purchase price (including all surcharges) has been received by Fabru GmbH. 
 
6. Warranty and repairs
 
6.1 Right of return and exchange
In principle, the customer has no right of return or exchange.
6.2 Procedure in the event of defective devices
The customer can assert a defect in the device, provided there are no grounds for exclusion. Reasons for exclusion can in particular be elementary damage, moisture damage, impact or fall damage, natural wear and tear, software problems, incorrect manipulation, damage caused by external influences as well as interventions in the product or its modification. Wearing parts, batteries, rechargeable batteries, lamps and housing parts are excluded from the guarantee.
Defective devices will not be picked up. The customer must send the defective device to Fabru GmbH at his own risk and expense.
6.3 Guarantee period
The guarantee period can be seen on the delivery note for each item. This is at least 2 years for new devices. The guarantee exchange or the guarantee repair does not lead to an extension of the original guarantee period. The guarantee does not restrict the statutory warranty obligation.
The guarantee period begins at the time of delivery. If there is a waiting time until delivery, the guarantee period does not yet run. In this respect, the warranty period of several devices ordered at the same time may differ in the case of a partial delivery.
 
7. Data protection
 
An order for goods and / or information about certain products is generally only possible if the customer registers on www.fabru.eu. Regardless of an order, he has to provide his user name (e-mail), his official first and last name, the address of residence reported to the authorities, his date of birth, the desired language and a valid telephone number. When shopping via the individual customer account, a password must also be defined.
Before each purchase, a credit check is carried out with the authorities and / or specialized providers.
 
 
8. Place of jurisdiction, applicable law
 
These general terms and conditions can be changed at any time. Only Swiss law is applicable. The place of jurisdiction is at the customer's place of residence or at the headquarters of Fabru GmbH.
